U.S. adds jobs but labor market still struggles

The U.S. economy has been bolstered by the addition of 146,000 jobs last month yet a drop in the unemployment rate is "misleading" because it reflects more people leaving the work force, according to one expert.

"For every job being created, about two people left the labor force," said Michael Goodman, a University of Massachusetts Dartmouth public policy professor. "That does not mean positive job growth isn't good for those 146,000 people and their families. It's extremely good news and a step in the right direction for them and the country."

The unemployment rate dropped two-tenths of a percentage point to 7.7 percent, the lowest since December 2008. The U.S. government added Hurricane Sandy had only a small effect on the national figures even though the construction sector lost 20,000 jobs.

However, employers added 49,000 fewer jobs in October and September than initially estimated. People who have stopped looking for work are not counted as unemployed.

"We've got a recovery that's underway but we have a profound long-term unemployment problem that's making it very difficult for workers across the country," Goodman said. "Those two things can happen at the same time and they are happening at the same time."

Goodman added that the looming "fiscal cliff" deadline would cause employers to hold off hiring new workers until there's more certainty about tax increases, as opposed to simply laying people off.

Reconstruction efforts in the wake of Hurricane Sandy — particularly in New York and New Jersey — would also "put some wind in the sails in the national construction industry," Goodman said.

"Over time I think reconstruction efforts should be expected to create opportunities for firms and for workers who are going to put New York and New Jersey back together again," he said.

Demand, prices rise for Bay State homes

With only a month to go before the end of the year, housing trends for 2012 are taking shape.

Demand for single-family homes and condominiums for the first 11 months of the year was up across all price points in Massachusetts, whereas in the same stretch of 2011 higher-end sales, those valued at $1 million and above, helped prop up the market.

The volume of single-family homes and condos in the Bay State jumped 18 percent for the first 11 months of 2012 compared to the same time in 2011, with prices continuing a modest increase, according to data obtained from Multiple Listing Service PIN. The median price of residential homes in Massachusetts gained 1 percent to $292,000 from $289,000 in the year-ago period.

An improving job market and low interest rates are two of the biggest drivers for the uptick in sales volume, but prices are just starting to show a consecutive upward trend this year.

"Tightened credit is a major hold-back to a full recovery in Massachusetts as well as the rest of the country. 2013 will bring a continued steady climb in the housing market with a few stops and starts along the way," said Nicolas Retsinas, a senior lecturer in real estate at Harvard Business School and director emeritus of Harvard's Joint Center for Housing Studies.

Larger price gains were noted in the Boston market and select suburbs. Sales volume in the Hub was up 27 percent compared to the first 11 months of 2011, and the number of transactions was up 23 percent compared to last year.

The median price for a home in Boston rose 6 percent, from $375,000 to $400,000, according to Multiple Listing Service PIN.

A lack of inventory for new construction, slowed mainly by lack of capital over the past few years and a lack of buildable sites, contributed to Boston's price increase.

Meanwhile, the pace of sales continued to increase, with properties on the market 84 days for the first 11 months of 2012 compared to 102 days during the same period in 2011.

Statewide, home and condo sales had slightly less rosy numbers, with properties on the market for 123 days in 2012, compared to 129 days in 2011.

Anemic inventory levels across Massachusetts and especially in urban Boston will continue into 2013 as new housing developments just begin to enter the market and homeowners remain reluctant to put their property on the block.

"Sellers are continuing to wait for home prices to rise," Retsinas said.

Rents will continue to rise as households are driven to the rental market as opposed to home purchases because of strict lending requirements.

"The credit hurdles people face will continue to put a damper on the home buying market in 2013," Retsinas said.

Sandy is thought to have slowed US hiring in Nov.

WASHINGTON — Superstorm Sandy is widely thought to have slowed U.S. job growth last month. The only question is how much — an answer that's expected to emerge Friday in the government's jobs report for November.

Yet once the storm's impact is cleared away, the report may reveal that the job market is strengthening.

Many economists predict employers added fewer than 100,000 jobs last month, and some think it was fewer than 50,000. That would be far below the 171,000 created in October and normally a sign of a weak market. The unemployment rate is expected to remain 7.9 percent.

Analysts caution, though, that Sandy likely reduced the November job gains significantly. And some employers might have delayed hiring because of concerns that the economy will fall off the "fiscal cliff" next year. That's the name for tax increases and spending cuts that will take effect in January if Congress and the White House fail to reach a budget deal by then.

If not for those factors, some analysts estimate the job gains in November might have been as high as 200,000. That would represent the best month of hiring since February.

Sandy forced restaurants, retailers and other businesses to close in late October and early November in 24 states, particularly in the Northeast. Many people couldn't get to work and weren't paid. The government counts those cases as job losses, even if they are temporary. Those subtractions would reduce net hiring.

One encouraging sign is that the storm's effect is fading. Weekly applications for unemployment benefits have tumbled in the past three weeks after spiking in early November to an 18-month high of 451,000 because of Sandy.

Last week, applications fell to a seasonally adjusted 370,000. That's roughly the same level as before the storm and is consistent with moderate hiring.

Payroll provider ADP said Wednesday that businesses added 118,000 jobs in November, down from 157,000 in the previous month. Mark Zandi, chief economist at Moody's Analytics, which helps compile data for ADP, estimated that the storm lowered the job gains by about 86,000.

The payroll losses from the storm could be higher in the government's total. That's because ADP counts people as employed if they remain on a payroll — even if they're not paid. By contrast, the government counts people as employed only if they are paid.

The fiscal cliff's impact on hiring may be harder to quantify. Even if companies aren't cutting jobs because of the cliff, the uncertainty surrounding the outcome is likely delaying some hiring, economists say.

Measures of hiring fell in two surveys released this week by the Institute for Supply Management, a private trade group of purchasing managers. Some companies in the service sector told the ISM that economic uncertainty was delaying hiring.

The storm also held back consumer spending and income, which drive economic growth. Consumers spending fell 0.2 percent in October, the weakest showing since May. Incomes were flat, after rising 0.4 percent in September.

Work interruptions caused by Sandy reduced wages and salaries in October by about $18 billion at an annual rate, the government said.

The U.S. grew at a solid 2.7 percent annual rate in the July-September quarter. But many economists say growth is slowing to a 1.5 percent rate in the October-December quarter, largely because of the storm and threat of the fiscal cliff. That's not enough growth to lower the unemployment rate.

Still, many say economic growth could accelerate next year if the fiscal cliff is avoided. The economy is also expected to get a boost from efforts to rebuild in the Northeast after the storm.

Yo-Yo Ma strikes right note

Cellist Yo-Yo Ma wowed students yesterday with a performance at Harvard's iLab and urged them to find new, collaborative ways of solving cultural problems.

"Our hope is that we will be able to find amongst all of you new thinking, new discoveries," he told students.

Ma's performance with his traveling Silk Road Ensemble, an eclectic group of musicians from across the globe, marked the launch of the Deans' Cultural Entrepreneurship Challenge, a university-wide competition encouraging students to work across majors and across colleges to develop solutions that support the arts and artists in a sustainable manner.

"Undergrads feel a lot of pressure. 'Oh, my God, I have to pay back my loans,' " Ma told the Herald after the performance. "But there are people who create their own jobs. So don't close off doors. Keep looking. If you go a little farther, you can find something incredibly worthwhile, something society hasn't moved quickly enough to help."

Nitin Nohria, dean of Harvard Business School, said the challenge was developed in partnership with Ma and his not-for-profit, the Silk Road Project, after the cellist raised the possibility of working together over dinner one night.

"Most ideas that come from electric dinners die," Nohria said. "I'm very grateful this idea didn't. It's a dream to have this interface between the arts and entrepreneurship. The world is not going to be a place we want to live in if we don't have the arts."

Diana Sorensen, dean of arts and humanities, said she hopes the competition will result in "inspired but practical" ideas for ways that artists can support themselves and still do what they love.

The challenge is one of two competitions recently announced by Harvard University. The Deans' Health and Life Sciences Challenge will kick off on Dec. 11 with a talk at the iLab by Richard Lee of the Harvard Stem Cell Institute and professor of medicine at Harvard Medical School.

Both competitions offer a grand prize of $75,000 to be awarded to the winner and runners-up to support their projects. Finalist teams selected in March and April will receive financial support to further their projects before the Demo Day, when they will showcase their work. Winners and runners-up will be selected in May.

Investors bracing for fall

Companies have been awarding special dividends to beat an anticipated tax hike next year, but as uncertainty about the "fiscal cliff" continues, the path for the average investor is less clear.

Some financial experts say it's time to sell stocks to avoid higher capital gains taxes next year, but others advise snapping up those shares that tax-wary investors are dumping.

"There's a big cloud over all of us today because of all this uncertainty and how that will affect the stock market," said Art Ford, a certified public accountant and financial planner at Sullivan Bille in Tewksbury. "There's a concern people may lose money if they don't do something."

If Congress fails to reach an agreement by Dec. 31 on how to reduce the deficit, steep cuts in federal spending will take effect, and the Bush tax cuts will expire.

"The usual tax strategy is to defer income and accelerate deductions," said Jim Bailey, tax partner at Blum Shapiro in Rockland. "But given the fact that rates may rise next year, we've been advising clients to consider doing just the opposite."

Unless Congress acts, the capital gains tax rate, for example, will go from 15 percent to 20 percent for most filers. So someone who paid $30 for a share of a stock that's now worth $100 could sell it this year, pay 15 percent on it and buy it back next year at $100, Bailey said.

Other advisers are suggesting that clients accumulate cash in their portfolios.

"I'm not selling stocks," said Barry Armstrong, president of Armstrong Advisory Group, a Needham wealth-management firm. "The closer we get to the 21st (of December), when Congress is expected to go home, the worse it'll be for stocks."

Instead, Armstrong is buying what everybody else is selling because those stocks are cheaper now than they most likely will be next year.

Evan Dangel, senior vice president at Morgan Stanley, said the likelihood that Congress is going to reach an agreement by the end of the year is "slim to none."

"We think taxes are going to be higher next year no matter what," Dangel said.

His advice is four-fold:

• Sell some stocks to realize long-term capital gains in your portfolio because the tax rate now is only 15 percent.

• Make sure you've contributed as much as you can to your 401(k).

• For the wealthiest taxpayers, deductions for charitable donations could be curtailed next year, so accelerate any charitable giving you plan to do this year.

• The stock dividend tax rate, which is now 15 percent, will probably be higher next year. People in the highest tax bracket, for example, could end up paying more than 40 percent. So you should consider tax-free municipal bonds and invest in stocks that don't pay dividends.

Dr. Timothy Johnson retires after 40 years at Ch. 5

Dr. Timothy Johnson is retiring from Channel 5 — where the nationally renowned TV doctor got his small screen start — after a 40-year run as the Boston station's award-winning medical editor that led to a slot on "Good Morning America."

"It just seemed like the right time," Johnson said yesterday, just before his WCVB-TV colleagues feted him with a farewell party.

"Forty years is a nice, round number, and I'm 76. I don't want to feel any responsibility to the daily news anymore," he said.

Johnson came to the Bay State to take a job as director of emergency services at Union Hospital in Lynn and later became a fellow at Massachusetts General Hospital.

One of his doctor friends was among the group that launched WCVB in 1972 and asked Johnson to host a new show called "House Call."

Johnson caught the eye of ABC and was invited to appear on "Good Morning America" when it debuted in 1975. He took a full-time job with ABC News in 1984. He stopped actively practicing medicine off-screen that same year.

"I loved medicine, and I loved practicing it," Johnson said. "I loved the emergency room, but I was aware that this was a wonderful way to reach out to a wide audience with information."

He was born and raised in Illinois. He wanted to be a minister but during seminary training he decided to become a doctor after seeing how they could help people "very directly."

Among the people his TV career led him to was a Boston detective dying of Lou Gehrig's disease who spoke "very movingly" about his faith. He died two weeks after Johnson interviewed him. Johnson recalled sitting in his car, "kind of crying about this man who was just a magnificent human being and clearly knew he was dying."

During his Channel 5 career, Johnson also reported on the late Sen. Edward M. Kennedy's brain cancer, interviewed former Gov. Mitt Romney and Gov. Deval Patrick about health-care reform, and sat down with medical titans and patients battling grim illnesses.

Johnson, who retired from ABC in 2010, said despite all his years on television, he never felt like a TV personality.

"I've always felt like a doctor who just happens to be on TV," said Johnson, who lives in Marblehead with his wife of nearly 50 years. "I've really always felt like I'm talking to patients, rather than doing any kind of performance."

US economy adds 146K jobs, rate falls to 7.7 pct.

WASHINGTON — The U.S. economy added 146,000 jobs in November and the unemployment rate fell to 7.7 percent, the lowest since December 2008. The government said Superstorm Sandy had only a minimal effect on the figures.

The Labor Department's report on Friday offered a mixed picture for the economy.

Hiring remained steady during the storm and in the face of looming tax increases. But the government said employers added 49,000 fewer jobs in October and September than initially estimated.

And the unemployment rate fell to a four-year low in November from 7.9 percent in October mostly because more people stopped looking for work and weren't counted as unemployed.

There were signs that the storm disrupted economic activity. Construction employment dropped 20,000. And weather prevented 369,000 people from getting to work — the most in almost two years. They were still counted as employed.

Stock futures jumped after the report. Dow Jones industrial average futures were down 20 points in the minutes before the report came out at 8:30 a.m., and just after were up 70 points.

As money moved into stocks, it moved out of safer bonds. The yield on the benchmark 10-year U.S. Treasury note, which moves opposite the price, rose to 1.63 percent from 1.58 percent just before the report.

Since July, the economy has added an average of 158,000 jobs a month. That's a modest pickup from 146,000 in the first six months of the year.

The increase suggests employers are not yet delaying hiring decisions because of the "fiscal cliff." That's the combination of sharp tax increases and spending cuts that are set to take effect next year without a budget deal.

Retailers added 53,000 positions while temporary help companies added 18,000 and education and health care also gained 18,000.

Auto manufacturers added nearly 10,000 jobs.

Still, overall manufacturing jobs fell 7,000. That was pushed down by a loss of 12,000 jobs in food manufacturing that likely reflects the layoff of workers at Hostess.

Stocks turn higher on jobs number, but fears loom

NEW YORK — The stock market turned higher this morning on news that the U.S. added more jobs in November. But underneath the headline numbers, the government's monthly employment report gave a mixed read on the economy.

The Dow Jones industrial average was up 57 points at 13,130 after the first half-hour of trading. The Standard & Poor's 500 index rose two to 1,416. The Nasdaq composite index edged down a fraction of a point to 2,989.

The main numbers from the jobs report were encouraging. The Labor Department said the U.S. added 146,000 jobs last month. The unemployment rate fell to 7.7 percent from 7.9 percent, the lowest level since December 2008. That was in the middle of the recession, and just as the unemployment rate was starting to shoot decisively higher.

However, the details of the report painted a much less positive view of the economy. The unemployment rate fell largely because discouraged unemployed workers stopped looking for work, and weren't counted among the unemployed. Also, the Labor Department revised previously released jobs numbers downward, saying that employers added 49,000 fewer jobs in October and September than initially estimated.

Nicholas Colas, ConvergEx chief market strategist, wasn't impressed. In a note to clients, he said U.S. unemployment seems to be more consistent with "an ongoing recession than expansion."

In the recession of the early 1990s and its aftermath, the highest rate of unemployment was 7.8 percent. In the recession of the early 2000s and its aftermath, the unemployment rate never got above 6.3 percent.

The jobs report also couldn't erase the overhang of other challenges, notably the "fiscal cliff" drama in Washington. Congress and the White House are trying to hammer out an agreement on government spending and tax rates before Jan. 1. If they don't, lower spending and higher taxes will kick in.

The drama has made traders indecisive, as many are unwilling to make any big moves until they know how the budget negotiations will be resolved. The markets have been wishy-washy. In the 21 trading days since the presidential election, the Dow has been up 10 and down 11. So far this week, it's finished up twice and down twice.

News from overseas wasn't encouraging. The Asian Development Bank, a lending institution based in the Philippines, predicted that growth will slow next year in India, South Korea, Hong Kong, Taiwan and other parts of Asia.

Germany's central bank, the Bundesbank, sharply slashed its predictions for its own country's economic growth next year. Greece reported that its economy shrank again in the third quarter, by nearly 7 percent. And earlier this week, the European Central Bank predicted that the recession plaguing the euro zone, which encompasses the 17 countries that use the euro, will continue next year.

Among the companies making big moves:

—Apple was down $1.96 to $545.28. The move amounted to less than 1 percent, but it's significant because it's part of a longer trend. Apple's stock has plunged more than 20 percent since the iPhone 5 went on sale Sept. 21, as investors wonder whether the company, still enjoying immense popularity for the iPhone and iPad, can keep the momentum going. Apple makes up 4 percent of the S&P 500 index and nearly 12 percent of Nasdaq, so how it fares can have an enormous effect on the rest of the market.

—AIG, the bailed-out insurance company, jumped nearly 3 percent, rising 93 cents to $34.19. A group of Chinese companies is reportedly in talks to buy AIG's aircraft leasing unit, which could help AIG raise cash to pay off more of its government loans.

—Cisco Systems, the company that makes Internet networking gear, jumped about 1 percent, rising 17 cents to $19.65. CEO John Chambers, speaking at the company's analyst day, reportedly told analysts that he expects to expand the company from gear making into software and other services.

Watertown's Riverworks office complex adds 3 tenants

The recently renovated Riverworks complex in Watertown has signed three office leases, broker Jones Lang LaSalle announced.

Mimecast North America, Fresh Tilled Soil and Kearsarge Energy signed long-term leases totaling nearly 50,000 square feet of space at the former mill building complex on the Charles River.

Boston-based Farley White Interests bought the property — previously occupied by Boston Scientific — in 2010 and reopened it in May. The leases bring the 200,000-square-foot complex to 46 percent occupancy, Jones Lang LaSalle said.

"These new leases bring us three innovative companies which will add to the dynamism of Riverworks," said Farley White principal Sam Altreuter. "We are enjoying seeing this grand facility come back to life."

Mimecast, an email management software provider, will double in size with the move from the Waltham Watch Factory building to 33,669 square feet on the first floor at the brick-and-beam Riverworks.

Web design firm Fresh Tilled Soil will quadruple its footprint when it relocates in January, also from the Watch Factory building, into 14,230 square feet on the third and fourth floors.

Kearsarge Energy, a renewable energy financing, operating and management company, is moving One Gateway Center in Newton to a 1,666-square-foot suite off the lobby.

TV helicopter news coverage pioneer dies in California

CAMARILLO, Calif. — The Los Angeles television engineer who won Emmy Awards for creating helicopter news coverage in 1958 has died in Southern California at 92.

The family of John D. Silva tells the Los Angeles Times that he died Nov. 27 of pneumonia complications in Camarillo.

Silva was the chief engineer for KTLA-TV when he outfitted a rented Bell helicopter with a TV camera to create a flying TV studio. The station broadcast live aerial coverage of major news events, including earthquakes, fires and freeway calamities.

Silva had to persuade KTLA executives to spend $40,000 on broadcast equipment that might not have worked. Then, he had to get a ton of TV equipment down to 368 pounds so the helicopter could lift off the ground.

AG pushes energy reform at retail confab

State Attorney General Martha Coakley would like to see the state tackle energy in the same way it's approaching health care reform.

Energy, like health care, is a major cost-driver for small businesses, Coakley said in a keynote address at the Retailers Association of Massachusetts' Awards of Excellence luncheon at Bentley University in Waltham yesterday.

"If it's not kept under control, if it's not contained, it's one of those costs that breaks the camel's back," Coakley said.

Coakley, who noted she's been sounding the alarm in the past few months about the need for cost-effective energy, said her attendance at a recent national conference showed that the stakeholders in the energy debate — the energy industry, legislators and retailers — "aren't that far apart."

Ikea regrets use of forced labor in East Germany

BERLIN — Swedish furniture giant Ikea expressed regret Friday that it benefited from the use of forced prison labor by some of its suppliers in communist East Germany more than two decades ago.

The company released an independent report showing that East German prisoners, among them many political dissidents, were involved in the manufacture of goods that were supplied to Ikea 25 to 30 years ago. The report concluded that Ikea managers were aware of the possibility that prisoners would be used in the manufacture of its products and took some measures to prevent this, but they were insufficient.

"We deeply regret that this could happen," said Jeanette Skjelmose, an Ikea manager. "The use of political prisoners for manufacturing was at no point accepted by IKEA."

But she added that "at the time we didn't have the well-developed control system that we have today and we clearly did too little to prevent such production methods."

Ikea commissioned auditors Ernst & Young to look into allegations aired by a Swedish television documentary in June, but first raised by a human rights group in 1982.

Rainer Wagner, chairman of the victims' group UOKG, said Ikea was just one of many companies that benefited from the use of forced prison labor in East Germany from the 1960s to 1980s.

"Ikea is only the tip of the iceberg," he told The Associated Press in an interview earlier this week.

Wagner said he hoped that Ikea and others would consider compensating former prisoners, many of whom carry psychological and physical scars from arduous labor they were forced to do.

"Ikea has taken the lead on this, for which we are very grateful," he told a news conference in Berlin, where the findings of the report were presented.

Peter Betzel, the head of Ikea Germany, said the company would continue to support efforts to investigate the use of prisoners in East Germany in future.

Today, he said, "we can exclude with almost 100 percent certainty that such things as happened in East Germany happen elsewhere."

US industrial production drops 0.4 percent

WASHINGTON — Superstorm Sandy depressed U.S. industrial output in October, while production of machinery and equipment declined sharply, reflecting a more cautious outlook among businesses.

The Federal Reserve says industrial output fell 0.4 percent last month, after a 0.2 percent gain in September. Excluding the storm's impact, production at the nation's factories, mines and utilities would have been up about 0.6 percent.

Factory output, the most important component, fell 0.9 percent. It would have been unchanged without the storm. Machinery production fell 1.9 percent, while production of electrical equipment, appliances and components declined 1.4 percent.

Manufacturing has weakened since spring, partly because companies have scaled back purchases of equipment and machinery. Many are worried about tax increases and federal spending cuts that take effect in January unless Congress reaches a budget deal.

Foreign holdings of US debt hit $5.46 trillion

WASHINGTON — Foreign demand for U.S. Treasury securities rose to a record level in September for the ninth straight month. The increase suggests overseas investors are confident in U.S. debt despite a potential budget crisis.

The Treasury Department says total foreign holdings rose to $5.46 trillion in September, up 0.1 percent from August.

China, the largest holder of U.S. government debt, barely increased its holdings in September to $1.16 trillion. Japan, the second-largest holder, increased its holdings to $1.13 trillion. Brazil trimmed its holdings to $267 billion.

Investors continued to buy U.S. Treasurys, even as lawmakers and President Barack Obama remained at odds over whether to raise the U.S. borrowing limit as part of a broader budget deal.

Hostess shutdown hits Mass. workers in stomach

Hostess Brands Inc., whose sweet treat roster includes Twinkies, Ding Dongs and Ho Ho's, filed a motion today in bankruptcy court seeking permission to shut down its business and sell its assets, including its iconic brands and facilities.

The company, based in Irving, Texas, is moving "promptly" to lay off most of its 18,500-member workforce, which includes nearly 300 workers at 13 Hostess facilities in Massachusetts, and has suspended bakery operations at all its plants, said company CEO Gregory F. Rayburn.

The company's board of directors authorized the wind down of Hostess Brands after one of its largest unions, the Bakery, Confectionery, Tobacco Workers and Grain Millers International Union, initiated a nationwide strike that crippled the company's ability to produce and deliver products at multiple facilities, company officials said.

In September, the union rejected a "last, best and final offer" from Hostess designed to lower costs so the company could attract new financing and emerge from Chapter 11 bankruptcy, Rayburn said.

Delivery of products will continue and Hostess Brands retail stores will remain open for several days in order to sell already-baked products. The company permanently closed three plants as a result of the work stoppage on Nov. 12. Two days later, Hostess said it would be forced to liquidate if sufficient employees did not return to work to restore normal operations by 5 p.m. yesterday. The company then determined yesterday night that an insufficient number of employees had returned to work to enable the restoration of normal operations, Rayburn said.

"We deeply regret taking this action. But we simply cannot continue to operate without the ability to produce or deliver our products," Rayburn said in a letter to employees. "All Hostess Brands employees will eventually lose their jobs — some sooner than others. Unfortunately, because we are in bankruptcy, there are severe limits on the assistance the company can offer you at this time."

The wind down will result in the closure of 33 bakeries, 565 distribution centers, nearly 5,500 delivery routes and 570 bakery outlet stores throughout the country. In addition to dozens of baking and distribution facilities in the United States, Hostess will sell its popular brands, which also include Drakes, Dolly Madison, and Wonder Bread.

In May, the company sent letters to Massachusetts officials and high-ranking politicians in 10 communities warning that its statewide facilities could shut down.

Affected state Hostess facilities include 91 Foster St. in Brockton; 601 Pond St. in Braintree; 189 Crawford St. in Fitchburg; 647 Andover St. in Lawrence; 420 Eastern Ave. in Malden; 323 Dalton Ave. in Pittsfield; 1566 State St. in Springfield; 2406 Cranberry Highway in Wareham; 215 West Boylston St., West Boylston; and four locations in Worcester at 75 Quinsigamond Ave., 39 SouthWest [LUV] Cutoff, 205 Chandler St., and 983 Milbury St.

Cruiseport Boston books record season

Cruiseport Boston finished the 2012 season with a record 380,054 cruise vacationers, a 23 percent spike over 2011, according to the Massachusetts Port Authority.

Fueling the surge was Carnival Cruise Lines' "Carnival Glory," which began cruising from Boston to Canada in June. With a dozen four-, five- and seven-day cruises from Cruiseport Boston to Canada in June and July, the ship contributed some 85,000 passengers to the Black Falcon Cruise Terminal's yearly count, Massport said.

This year, 117 cruise ships docked at Boston, a 9 percent increase over 2011 — 63 of which began and/or ended their cruise in the Hub. In addition to the cruise passengers, who came from the all over the United States, Canada, Europe and Australia, more than 100,000 crew members visited Boston. The 54 other cruise ships stopped in Boston for a day or more to allow their passengers to tour the city and surrounding areas.

In addition to "Carnival Glory," Cruiseport Boston offered new choices for Canada and New England cruising, including Holland America's "Veendam," which offered seven-day sailings to Montreal as well as a repositioning cruise to South America via the Panama Canal. Three luxury lines — Compagnie du Ponant, Seabourn and Crystal Cruises — offered seven- and 10-day voyages to Canada and New England ports. "Norwegian Dawn," in addition to regular Bermuda cruises, sailed seven-day itineraries to Quebec, Massport said, adding that Canada and New England cruises more than doubled in 2012, growing by 119 percent.

During Hurricane Sandy, five ships destined for New York cruise terminals were diverted to Boston, during which time 9,000 passengers came to the Hub on the unscheduled ship visits, Massport said. Cruisers will also see more summer cruising options from Cruiseport Boston to Canada next year, the agency said.

Convention center seeking hotel developers

The Massachusetts Convention Center Authority said today it has issued a request-for-proposals seeking development teams for two privately financed mid-priced hotels, totaling between 400 and 500 rooms on nearly three of the 5.6 acres of land the organization recently purchased near the Boston Convention & Exhibition Center.

Proposals are due Jan. 7, 2013, with groundbreaking for the new hotels scheduled to take place by late 2013 and completion by 2015, said MCCA Executive Director James E. Rooney.

"We have set the bar very high, but we also think we're providing a great opportunity," he said.

The MCCA expects the two hotels to be built next to each other, and to benefit from sharing certain facilities, including fitness rooms, kitchens and service areas. The MCCA is also requiring that the hotels include leasable ground floor retail or restaurant space in a move aimed at activating the entire D Street corridor in the South Boston Waterfront.

The hotels are geared to be mid‐priced, with room rates and amenities below the existing four-star hotels in the area, Rooney said.

Under the RFP, the MCCA plans to build and own a parking facility, to be used by hotel guests and the MCCA, and to establish a ground lease structure for the hotels. Developers will be responsible for designing the structures and 100 percent financing, building, owning and operating the hotels.

The project is expected to create 370 construction jobs and 175 permanent jobs, Rooney said.

"Between the revenues realized by the MCCA and the substantial tax revenues generated for the city and state, this land acquisition will have a high and fast payback; a win for the taxpayers," he said.

'The D.A. Show' overnight success on CBS Sports Radio mother ship

CBS Sports Radio said today Damon Amendolara will host the network's weekday overnight show, which will debut Wednesday, Jan. 2, 2013.

"The D.A. Show" will be heard on select stations in 12 major U.S. cities from 2 a.m.-6 a.m. on air, streaming online and through the Radio.com application for mobile devices.

Amendolara joins the network from CBS Radio Boston's WBZ-FM "98.5 The Sports Hub," where he has served as evening host since the station's launch in August 2009. In addition, Amendolara is the sideline reporter for the New England Revolution on Comcast and a frequent guest and fill-in host for CSN's Sports Tonight/Sports Sunday.

"D.A. is an all-star in Boston, and his energy and understanding of the sports world will no doubt translate to a national platform," said Eric Spitz, director of programming for CBS Sports Radio. "Damon is certainly the man to keep listeners engrossed overnight, and his work at stations across the country, covering a multitude of different sports, will be beneficial to our listeners. The Davis Cos. raises $414M for second investment fund

The Davis Companies said it has completed fund raising for its second discretionary commingled investment vehicle, Davis Investment Ventures Fund II, with nearly $414 million of total commitments from institutional and high net worth investors.

The offering initially targeted $350 million and was oversubscribed, the real estate investment firm said.

The fund aims to continue the firm's history of value-oriented, opportunistic investing, and looking for debt and equity investments in the United States with a focus on Northeast markets where the firm can leverage its operating platform, Davis said.

The firm added that it currently owns and manages nearly 6 million square feet of real estate in the region with a 95 percent occupancy rate, and has acquired an additional $700 million of real estate debt, equity and securities within the last two years.

Fund II is fully discretionary and has four years remaining in its investment period. The fund is structured to allow joint ventures with outside capital sources seeking to partner with operating companies, as well as with other operators seeking capital or additional operating expertise and to provide recapitalization and bridge financing, the firm said.

Glaxo's Avandia settlement will mean $2.1M for Massachusetts

A nationwide $90 million settlement with drugmaker GlaxoSmithKline LLC will bring more than $2.1 million to the Commonwealth, according to state Attorney General Martha Coakley.

Coakley's office has joined 37 other states in the settlement with GlaxoSmithKline, which resolves allegations the pharmaceutical company unlawfully promoted its diabetes drug, Avandia, by misrepresenting its cardiovascular risks and safety profile.

"When pharmaceutical companies misrepresent the safety of their drugs, they put patients at risk," Coakley said. "This settlement helps ensure that consumers will be protected from misleading marketing that can result in the unsafe use of prescription drugs."

Coakley's office alleged GSK promoted the diabetes drug to physicians and other health-care providers with false and misleading representations about its safety and misrepresented the drug's cardiovascular benefits when, in fact, the drug may instead increase risks, all in order to increase their sales of Avandia in the Bay State.

The $2.1 million settlement includes $100,000 for fees and investigative costs, while the remaining funds will pay for programs that lower costs for Massachusetts residents, combat unlawful marketing practices or benefit health-care consumers, Coakley said.

As part of the settlement, GSK agreed to reform how it markets and promotes diabetes drugs, and is prohibited from making any false or deceptive claims about any diabetes drug; making comparative safety claims not supported by substantial evidence or clinical experience; promoting investigational drugs; presenting favorable information previously thought of as valid but rendered invalid by contrary and more credible recent information and misusing statistics or otherwise misrepresenting the nature, applicability or significance of clinical trials.

The consent judgment is in addition to a settlement announced in July when Coakley obtained more than $35 million from GSK, on behalf of the Massachusetts Medicaid Program, due to its unlawful marketing of a number of drugs, including Avandia.

Boston Scientific, among others, making moves

Major employers in MetroWest played another round of musical chairs yesterday as Boston Scientific made plans to move its headquarters to Marlboro and leave its Natick campus behind for software maker MathWorks.

Starting next spring, the medical device giant will shift about 800 jobs to the three-building Marlboro campus it bought in 2004 while in expansion mode.

"Consolidating our ... facilities is expected to foster greater collaboration and efficiency, benefitting our employees, our customers and, ultimately, the patients they treat," said new CEO Mike Mahoney.

Meanwhile, MathWorks is finalizing a deal to buy Boston Scientific's campus even as it finishes constructing a fourth building at its own bustling base a mile away on Route 9 where it employs 1,800.

"MathWorks is fortunate to be in a growth mode, and is pleased at the prospect of expanding into such a renowned property ... situated so close to our current campus," said Jeanne O'Keefe, MathWorks' finance chief.

Boston Scientific has occupied its three-building campus between the Natick Mall and Lake Cochituate since 1995. The site was previously home to Prime Computer in the 1980s and Carling's Brewery in the '70s.

The moves represent a win-win situation for Marlboro and Natick, suburbs known for their major corporations and job centers, according to Garry Holmes, a top MetroWest broker working for MathWorks.

"When the timing hits and you need some expansion space, there's only so many places they can make these big numbers work," said Holmes, president of R.W. Holmes Realty in Wayland. "I think it's a real positive and good to see these companies take advantage of the opportunities."

Marlboro's office vacancy rate spiked to 32 percent, the worst in Massachusetts, amid a corporate exodus that ended when retailer TJX said it would buy a campus Fidelity Investments was dumping for out-of-state digs, and Quest Diagnostics said it would fill an old Hewlett-Packard site with 1,200 workers.

"Companies continue to view Marlboro as an optimal location for their operations," said Tim Cummings, head of the city's economic development agency.

TJX subsequently purchased its longtime headquarters on the Natick-Framingham line. The operator of T.J. Maxx and Marshalls expects to eventually employ 1,600 at each campus.

The MathWorks growth will help make up for Natick losing longtime tenant BJ's Wholesale Club to Westboro. BJ's filled a former National Grid space.

Westboro is where the music started playing five years ago, when Framingham-based Bose expanded into an office complex abandoned by Hopkinton-based tech giant EMC.

The number of homes selling for $1 million and over in Massachusetts was 1,915 during the past year, almost unchanged from the 1,913 homes that sold for $1 million and over the year before. Here's a look at five properties that sold recently in the Bay State for a cool $1 million:

Students, mentors invest in StoxSmart

The Herald's StoxSmart program is back as a new class of budding student entrepreneurs learn the money management and financial skills necessary to tackle the unpredictable stock market.

Suffolk Construction CEO John Fish returns for a second year, this time to mentor two Madison Park Technical Vocational High School students.

The program's second installment also welcomes a new mentor, Dr. Ralph de la Torre, chairman and CEO of Steward Health Care System, who will team up with TechBoston Academy students Edson Brito and Ephraim Norman.

StoxSmart mentors, who include Herald business editor Frank Quaratiello and Cabot Money Management President Rob Lutts, work with their student partners to come up with the best way to invest $1 million in the stock market.

The contest officially kicks off Jan. 1 and runs through the first quarter. The Herald will keep tabs on the competition every Monday in the BizSmart section and with a blog at bostonherald.com.

"The idea here is to learn as much as you can and have some fun doing it," Herald publisher Patrick Purcell told students yesterday.

"Really try to make the most of the experience, because it's a unique one," added Editor-in-Chief Joe Sciacca.

Fish and de la Torre have agreed to provide complimentary iPads to the students and to work with other Hub business leaders to create summer internships.

"It's a fabulous time to get involved and ask a lot of questions and challenge yourself to ask those questions," Fish said.

Brito, a 17-year-old senior, agreed: "I want this to be a huge learning experience for me."

De la Torre said StoxSmart would establish "a framework to learn about business stocks as well as expand horizons."

"We're going to talk about the market and think about opportunities that are America- and world-driven," he said.

US futures off before Obama addresses fiscal cliff

NEW YORK — U.S. stock futures fell sharply Friday in some of the heaviest trading this week before President Barack Obama speaks about avoiding the so-called fiscal cliff, an issue that has driven markets lower since his re-election three days ago.

Dow Jones industrial futures slid 102 points to 12,673. The broader S&P futures gave up 11.2 points to 1,364.10. Nasdaq futures fell 14.75 points to 2,575.

What Obama says Friday from the White House will likely give markets a better idea of the path ahead in a showdown with Republicans, and the odds of avoiding the one-two punch of tax increases and automatic spending cuts that come due in January.

On the corporate front, J.C. Penney shocked investors again with a loss of $123 million for the quarter. Like the previous quarter, it is much worse than was expected.

Much of the turnaround push at J.C. Penney has been focused on modernizing tired and deteriorating stores. However, even online sales were terrible.

At a time when some retailers are seeing online sales double, sales through jcp.com plunged 37.3 percent from the same period last year.

It marked the third consecutive quarter of overall losses and plunging sales as well.

J.C. Penney shares fell 6 percent before the market opened.

MoneyGram agrees to settle scam charges

DALLAS — MoneyGram said Friday that it has agreed to set up a $100 million compensation fund as part of a settlement of government allegations of fraud through money-transfer scams from 2003 to 2009.

Under the terms of the deal with the U.S. Attorney's Office for the Middle District of Pennsylvania and the Department of Justice, MoneyGram International Inc. said it has also taken other steps to prevent more scams. These include adding more investigators and beefing up technology to detect fraud.

The payment services provider said it has terminated relationships with the agents suspected of masterminding the fraud. It said it has also overhauled its corporate compliance program and began a new training program for agents to better sniff out and report scams.

The company previously set aside the money to compensate victims.

"The conduct described in the (settlement agreement) is unacceptable to MoneyGram and counter to everything we strive to stand for," said Pamela H. Patsley, chairman and chief executive officer, in a statement. "We take compliance very seriously at MoneyGram, and nothing angers us more than when our services are used to perpetrate illegal activity."

The Dallas-based company also said Friday that it lost $54.1 million, or 77 cents per share, in its third quarter due to costs related to the fraud settlement and related legal expenses. It had net income of $15.8 million, or 22 cents per share, a year ago.

Its revenue rose 5 percent to $338.6 million from $322 million a year ago.

It now expects full-year earnings to come in at the low end of its previous expectations.

Chrysler to recall 919,000 SUVs to fix air bags

DETROIT — Chrysler is recalling more than 919,000 older-model Jeep Grand Cherokee and Liberty SUVs worldwide because the air bags can inflate while people are driving them.

The recall affects Grand Cherokees from the 2002 through 2004 model years and Libertys from model years 2002 and 2003, according to documents posted Friday on the U.S. National Highway Traffic Safety Administration website.

The safety agency said that a part can fail in the air bag control computer, and the front and side air bags can inflate while the SUVs are being driven. An agency investigation started last year found that the air bags went off 215 times, causing 81 minor injuries. No crashes were reported, but NHTSA said the problem could cause a wreck.

Chrysler, which makes Jeeps, will install an electrical filter free of charge to fix the problem. The company will begin notifying owners of the recall in January.

The recall includes nearly 775,000 SUVs in the U.S., 49,000 in Canada and 22,000 in Mexico. The rest are outside North America.

Dashboard warning lights normally come on before the air bags are inflated, Chrysler spokesman Eric Mayne said. If that happens, the driver should contact a Jeep dealer.

The problem happens in less than three-hundredths of a percent of the vehicles on the road, Mayne said.

NHTSA began investigating the air bags in October of last year after getting complaints about air bags inflating for no reason in Jeep Libertys. Investigators traced the cause to electrical stress on one of two circuits in the control computer. The problem also causes the seat belts to tighten as if a collision were about to happen.

The Grand Cherokees covered by the recall were built from Aug. 1, 2001 to May 16, 2003, while the Libertys were built from June 6, 2001 to March 19, 2003.

'NBA 2K13' tops video games titles in October

NEW YORK — U.S. retail sales of new video game hardware, software and accessories fell 25 percent in October, marking the 11th straight month of declining sales for physical game products, according to a report from NPD Group.

Many gamers are waiting for big holiday releases such as Activision's "Call of Duty: Black Ops II."

NPD said sales fell to $755.5 million from $1 billion a year earlier. Sales of video games themselves, excluding PC titles, fell 25 percent to $432.6 million. Sales of hardware such as Microsoft's Xbox 360 fell 37 percent to $187.3 million. Sales of accessories, meanwhile, grew 5 percent to $135.6 million.

Thursday's study from NPD Group tracks sales of new physical products — about 50 percent of the total spending. Excluded are sales of used games and rentals as well as digital and social-network spending.

NPD also listed the top-selling games in October:

Brandon Lloyd's leap

By now, word has gotten out about Brandon Lloyd's daring jump over a car that was traveling 35 miles per hour as part of a challenge by Mobile Technology's company MobiSquad.

For those who were more than a little concerned the Patriots [team stats] wide receiver was unnecessarily risking his health and jeopardizing his status with the AFC-East division-leading club, fear not.

The video of Lloyd's amazing leap, which was shot in Arizona during the offseason and is expected to be released early today, isn't quite what it seems.

Lloyd, in fact, yesterday admitted there were some "camera tricks" involved, and he would never put himself in harm's way with his career on the line. He understands how it might seem, but cautions not to get too caught up in the danger element.

''It's more so about the product than the actual act,'' Lloyd said. "As an athlete, when you do something like that, and it seems like there's a lot of danger involved, and there's a lot of controversy, it raises the awareness. The product is a mobile payment device for small businesses.

''I think that's more (the message) than the danger involved,'' he went on. ''Obviously, I'm not going to do anything to jeopardize my career ... so we can say I jumped a car for small business.''

Lloyd said if the personal risk was too great, he wouldn't have been involved. As for signing off with Patriots coach Bill Belichick, the wideout, who has 37 catches for 435 yards with three touchdowns, indicated he hadn't since it was filmed in the summer.

Also, to try and prevent people at home from trying to repeat the feat, Lloyd indicated there is "a large disclaimer" before the video warning this challenge is not advised.

LA Laker Kobe Bryant performed a similar stunt.

So why was Lloyd chosen to leap over MobiSquad's signature purple Smart Car?

He still holds his high school's record in the high jump at 7 feet, 2 inches, and wasn't too bad in the long jump and high hurdles.

Said Lloyd: ''It was amazing.''

The Pats receiver indicated he became involved through friend Nate Reis, the CEO of MobiSquad.

''He's been a friend of mine for three years,'' Lloyd said. ''He thought it would be a good idea to see if we could do a partnership. So we were just tossing around some ideas.

HapYak raises $850G in VC funding

HapYak.com, a Waltham-based social video commentary platform, said today it has secured $850,000 in seed funding to expand and build upon its platform.

The funding round was led by Kepha Partners with participation and coordination from CommonAngels of Boston and angel investor Tom Burgess, former CEO of Third Screen Media.

HapYak invites users to create drawings, record narration and add comments directly to any video from YouTube, Vimeo and other popular services. Platform users have already created hundreds of video commentary experiences that range from video game walkthroughs to vegan cooking to the presidential election, HapYak said.
